Delay is one of the most common causes of construction disputes. Whether a delay claim succeeds usually depends on what the contractor does during the project, not after it.
Timely notice
Most contracts require notice to the owner or engineer of any event that may cause delay within a set period. Late notice can bar a claim for extension of time or compensation.
Records
- The approved programme and its updates.
- Daily and weekly reports.
- Correspondence and meeting minutes.
- Labour, equipment and cost records.
Extension of time and compensation
An extension of time protects the contractor from delay damages, while compensation covers additional cost. Each has different proof requirements, and the link between the event and actual delay on the critical path must be shown.
Practical tip
Organise records and send notices from day one. Building a claim after completion without adequate records is far harder and less likely to succeed.
