Many tenants receive eviction demands without knowing their rights. Kuwaiti law regulates the landlord–tenant relationship and sets out when eviction may be sought.
Grounds for eviction
- Late payment of rent, under the conditions set by law.
- Using the premises for a purpose other than that agreed.
- Unauthorised subletting where the lease prohibits it.
- The owner's need for the property, in cases the law permits.
Eviction requires a judgment
A landlord may not remove a tenant personally or cut off services to force them out. Eviction takes place under a court judgment after the legal procedure has been followed.
If you receive an eviction demand
- Review the lease, its expiry date and terms.
- Keep your rent receipts.
- Do not ignore any court notice you receive.
- Take legal advice to assess your position.
