Tenants' Rights When Facing Eviction

When a landlord may seek eviction, and the procedure that applies.

Draft: this text is awaiting the firm's legal review before publication.

Many tenants receive eviction demands without knowing their rights. Kuwaiti law regulates the landlord–tenant relationship and sets out when eviction may be sought.

Grounds for eviction

  • Late payment of rent, under the conditions set by law.
  • Using the premises for a purpose other than that agreed.
  • Unauthorised subletting where the lease prohibits it.
  • The owner's need for the property, in cases the law permits.

Eviction requires a judgment

A landlord may not remove a tenant personally or cut off services to force them out. Eviction takes place under a court judgment after the legal procedure has been followed.

If you receive an eviction demand

  • Review the lease, its expiry date and terms.
  • Keep your rent receipts.
  • Do not ignore any court notice you receive.
  • Take legal advice to assess your position.
