A good contract prevents disputes before they arise. These are the key terms we recommend reviewing in any commercial contract in Kuwait.

Core terms

  • Precise identification of the parties and the authority of each signatory.
  • Scope of obligations and specifications.
  • Price, payment method and timing.
  • Term, renewal and termination.
  • Limitation of liability and indemnities.
  • Force majeure.
  • Governing law and dispute resolution.

Language

An Arabic version may be required before official bodies and the courts. For bilingual contracts, state which version prevails in case of conflict.

Check that the signatory has authority to bind the company, through the commercial register or formal powers of attorney.
